Appellate Litigation
Our lawyers have prepared records, submitted briefs, and conducted oral arguments at all appellate levels. We are admitted to practice in the North Carolina Supreme Court, the Fourth Circuit Court of Appeals, and the Supreme Court of the United States. We manage our own cases on appeal from the trial level and also assist other firms at the appellate level.
Construction
Our managing partner, Thomas H. Stark, Esq., is recognized as one of the leading construction lawyers in the area. Mr. Stark combines a thorough knowledge of commercial and residential construction practices and procedures with over twenty-five years of experience litigating construction defects and lien issues.
Corporations, Partnerships, and LLCs
Stark Law Group represents numerous profit and nonprofit corporations, partnerships, and Limited Liability Corporations. We draft articles of incorporation, partnership agreements, and operating agreements, negotiate purchases and sales of entities, and advise our clients through every state of corporate existence. We are particularly experienced in Limited Liability Corporations formed for development purposes.
Fraud and Breach of Fiduciary Duty Litigation
Our firm has filed and defended highly complex fraud and breach of fiduciary duty cases in the Eastern and Middle Districts of North Carolina, North Carolina Superior Court, and the North Carolina Business Court. We are experienced in representing cases alleging causes of action for breach of contract, fraud, constructive fraud, breach of fiduciary duty, and violations of the North Carolina Unfair and Deceptive Trade Practices Act. Many of our cases have involved fraudulent activity in real estate development partnerships and LLCs.

Local Counsel
Stark Law Group offers a range of local counsel services for federal actions in the Eastern and Middle Districts of North Carolina, and state court actions in Durham, Orange, Chatham, Wake and surrounding counties. We are set up for electronic filing in the Eastern and Middle District and Bankruptcy Courts, as well as in the North Carolina Business Court. We have experience practicing before many of the local state and federal judges, and are able to advise on local rules, practices, formatting and litigation strategy as requested.
Real Estate
Our firm offers a comprehensive package of real estate legal services, ranging from simple residential closings to negotiating and documenting complex commercial transactions and multi-million dollar property development. We have decades of experienced among our real estate staff and are able to assist potential clients in all aspects of real estate, including environmental, zoning, and other related areas of law.
At Stark Law Group, we have also litigated numerous real estate disputes. This experience helps us spot potential problems and work creatively toward their solution. We believe that there is no substitute for carefully thinking through all aspects of any transaction—and that is how we do real estate.
